Legal and Technological Aspects of AI: Situation in China, UK and EU

Dr. iur. Dr. phil. Adolf PETER, LL.M., MA, CSE is Professor at the Shanghai University of Political Science and Law (SHUPL), Consultant at the international law firm Fieldfisher (Vienna Office) and Co-Chair of the Legal & Compliance Committee of the British Chamber of Commerce Shanghai focusing on international commercial arbitration, the enforcement of ESG standards in international supply chains and EU law. A selection panel established by the European Commission found Dr. Peter suitable for appointment for the position of Arbitrator and Trade and Sustainable Development Expert in bilateral disputes under the EU’s trade agreements with third countries.

In his capacity as Certified Supervisory Expert recognized by the Austrian Economic Chambers (WKO) he holds specialized one-day seminars for the WKO in Vienna directed at supervisory board members of companies.

Dr. Peter is the author of numerous arbitration- and ESG-related publications in international law journals and the book “CSR and Codes of Business Ethics in the USA, Austria (EU) and China and their Enforcement in International Supply Chain Arbitrations” (ISBN: 978-981-33-6072-3).

He is listed as arbitrator in 10 international arbitration institutions, including the Shanghai International Arbitration Center (SHIAC), the Vienna International Arbitral Centre (VIAC), the China Maritime Arbitration Commission (CMAC), the Shanghai Arbitration Commission (SHAC), the Singapore International Arbitration Center (SIAC Reserve Panel), the Thailand Arbitration Center (THAC), etc.

Pascal is a partner of TMT Practice Group in Dentons Shanghai office. He has over 20 years of experience advising clients from Telecommunications, Media and Technology sectors, covering Internet information service, e-commerce, IT equipment and service, software, big data analysis, cloud computing, chip, blockchain, self-driving and new energy cars etc.

He excels at assisting foreign and Chinese investors to design appropriate investment and cooperation structures for making market entry in highly regulated sectors in China, improving the cooperation arrangements with partners, as well as protecting key intellectual property.  He has deep knowledge and practising experience in China’s data protection and cybersecurity compliance matters.  He has started to work for Chinese clients on outbound investments since 2008 and has a special focus on the mining and natural resources sectors.

Alex Roberts has been working in Shanghai with British-headquartered law firm, Linklaters LLP, since 2012 and previously studied and worked in Beijing (first in 2005). Alex has been involved with the Chamber almost since arriving in Shanghai and am proud to have seen its development over this time with a dedicated group of staff and members. Alex is passionate about continuing to drive British and international business opportunities in China through his legal expertise and network, helping to organise framework for knowledge-sharing events and improving the dialogue between the UK and China for the good of all stakeholders.

Kevin has over 15 years of working experience in information security management, IT risk management, and IT internal and external audit. His main clients are large SOEs and MNCs in retail, banking, insurance, FMCG, and manufacturing.

Professional experiences

•Kevin has rich experience in cyber security compliance, security risk management, and technical solution implementation. He has provided vulnerability test work for many MNC clients in various industries, including banking, insurance, manufacturing, retail, etc. 

•Kevin has rich experience in providing China Cyber Security Law-related consulting services to MNCs, including auto and auto finance industry clients. He has assisted various MNC clients in assessing based on CSL requirements, identifying potential non-compliance risks, and helping clients to remediate the issue properly. He also assists clients in establishing their security controls and framework based on MLPS, including grading the systems, establishing detailed security controls, identifying technical vulnerabilities, remedying the issues, and passing the MLPS inspection and certification process. 

•Kevin has provided different clients with various advisory services, including designing enterprise-level information security architecture, setting up an Information Security Management System, the assessment of ISMS based on ISO 27002, PCI DSS assessment for online payment, and security scanning for banking and insurance companies.  Kevin also provided an overall assessment of IT security governance and provided a short and long-term roadmap for the improvement of information security management.

•He used various technical tools to identify security risks for operating systems, databases, middleware, network devices, and applications. He provides an overall security risk assessment for the identified vulnerabilities based on the client’s as-is situation and provides detailed recommendations on how to remediate the technical issues. Kevin has rich experience in providing advisory implementation services regarding data protection. He provided data loss prevention for one large financial company and helped the client to perform as-is analysis, requirement analysis, vendor selection, product POC testing, product trial run, and final implementation.

•Regarding IT risk management, Kevin provided advisory services to one of the largest insurance companies in China to establish its IT risk management system. He helped the client to establish a formal risk assessment methodology, and draft and publish policies and procedures for managing risk throughout its life cycle. He leads the team to perform risk assessment for the IT department and provides advice for risk identification, assessment, handling, and monitoring.

Mr. Li Jia is the Senior Manager in the Big Data and AI Department at Baosteel. He is primarily responsible for overseeing the construction of the company’s big data platform and the development of data applications. With a wealth of experience in intelligent manufacturing project management and data governance implementation, Mr. Li brings invaluable expertise to the organization.

Amelia is the Director of Educational Technology and Innovation at Dulwich College Shanghai Puxi, where she supports staff and students to improve their digital and technological capabilities both in the classroom and in wider school life. She is passionate about developing creativity and a Maker Mindset in both adults and children, and believes in the importance of ‘playing’ with technology in order to develop confidence further. Her areas of interest include innovative technologies such as VR and the use of generative AI to augment education and support wellbeing in both students and teachers. Through this, Amelia recently led the school to win the inagural Tes International School Award for Best Use of Technology for the holistic use of AI in all areas, a clear sign that the College is using AI effectively to develop innovators of tomorrow!
