The Legal Aspects of the Environmental Component of ESG and Climate Change

Dr. iur. Dr. phil. Adolf PETER, LL.M., MA, CSE is Professor at the Shanghai University of Political Science and Law (SHUPL), Consultant at the international law firm Fieldfisher (Vienna Office) and Co-Chair of the Legal & Compliance Committee of the British Chamber of Commerce Shanghai focusing on international commercial arbitration, the enforcement of ESG standards in international supply chains and EU law. A selection panel established by the European Commission found Dr. Peter suitable for appointment for the position of Arbitrator and Trade and Sustainable Development Expert in bilateral disputes under the EU’s trade agreements with third countries.

In his capacity as Certified Supervisory Expert recognized by the Austrian Economic Chambers (WKO) he holds specialized one-day seminars for the WKO in Vienna directed at supervisory board members of companies.

Dr. Peter is the author of numerous arbitration- and ESG-related publications in international law journals and the book “CSR and Codes of Business Ethics in the USA, Austria (EU) and China and their Enforcement in International Supply Chain Arbitrations” (ISBN: 978-981-33-6072-3).

He is listed as arbitrator in 10 international arbitration institutions, including the Shanghai International Arbitration Center (SHIAC), the Vienna International Arbitral Centre (VIAC), the China Maritime Arbitration Commission (CMAC), the Shanghai Arbitration Commission (SHAC), the Singapore International Arbitration Center (SIAC Reserve Panel), the Thailand Arbitration Center (THAC), etc.

Jason JIA, Secretary General of China International Economic and Trade Arbitration Commission (CIETAC) Shanghai Sub-commission, Arbitrator of CIETAC, also Secretary General of the Permanent Forum of China Construction Law, Deputy Secretary General of China Real Estate Association Legal Affairs Committee, Director of China Woolen Textile Industry Association, and former Editorial Board Member of several journals such as Arbitration and Law, a professional journal on arbitration, and as an external tutor of the Law School of Renmin University of China and Xinjiang University.

Having over twenty years of experience in law and arbitration, he has handled nearly 400 international/foreign or domestic arbitration cases, co-operated with arbitrators from different jurisdictions, and managed cases applying the UNCITRAL Arbitration Rules and ICC Rules. His main areas of expertise include international trade, construction and engineering, equity transfer, and other types of disputes. He served as Assistant Secretary-General of CIETAC Tianjin Sub-commission and Deputy Secretary-General of CIETAC Shandong Sub-commission.

Antony specialises in public international law and complex cross-border dispute resolution. He leads our global Business and Human Rights practice and is a member of the firm’s ESG leadership group.

Antony has extensive experience advising governments, international organisations and private sector clients in the area of public international law, including in relation to investment treaty arbitration, State and diplomatic immunity, sanctions and embargoes, recognition of States and governments, treaty law, human rights and international economic law.

Antony is tri-qualified, in Australia (Victoria), England & Wales and Hong Kong SAR. He acts as an advocate in international arbitration proceedings and in arbitration-related court proceedings.

Antony is ranked in Chambers Global for Business and Human Rights Law where he is described as a “leading expert on human rights and business, well versed across the full spectrum of issues including legal, political, international and commercial perspectives.”

Monica has experience advising on energy, power and mining projects and transactions around the world, in particular advising major PRC companies on their outbound investment. Her practice covers M&A, joint venture, project development and project finance, private equity investment, corporate and corporate finance. She also has considerable experience in advising foreign clients on doing business in China.

Monica has advised on acquisitions and projects in jurisdictions including Australia, Indonesia, China, Africa, Russia, South America and the United Kingdom.

Monica worked in both our Hong Kong and Beijing offices from 2003 to 2007, and she rejoined our energy group in early 2010, after receiving a Master of Laws from the Harvard University School of Law in 2008 and working at the corporate division of a top Wall Street law firm.

Monica is licensed to practice law in the State of New York. She is fluent in Mandarin and English.

Tracy Xie is a passionate leader with more than 20 years experience of driving sustainable growth of business. Besides her full-time job, Tracy is also a certified International Arbitrator with an interest domain on ESG-related dispute resolution. In her personal time, Tracy likes reading and traveling. She is a curious explorer and conducted PhD research on Strategy & Sustainability to tackle the challenges in driving superior economic & environmental performance.

Julia Zhang has 14 years of practice experience in cross-border investment, private fund investment, foreign direct investment, asset management, and the financial institution industry. She has provided seasoned services to well-known international and domestic clients from regulatory compliance, equity and debt investment, establishment and investment of private funds, and asset management to general corporate matters.

Julia Zhang has in-depth theoretical and rich practical experience in the field of ESG. She is a leading member of the drafting committee for Shanghai New ESG Standard Rules. 

Weina is an international partner at our Joint Operation firm Kewei in Shanghai. Weina advises on cross-border commercial disputes and international arbitration. 

With over a decade of experience working in London, Hong Kong and mainland China, Weina has extensive experience in advising Chinese and multinational clients on the resolution and avoidance of complex and high-value cross-border commercial disputes. She also regularly represents clients in international arbitration cases.

Weina’s experience covers a range of commercial disputes in TMT, manufacturing, energy, infrastructure and hotel sectors and relating to M&A transactions, joint ventures and other types of commercial contracts.

Weina graduated from East China University of Political Science and Law and is qualified to practice in the PRC and in England & Wales. Her working languages are English and Mandarin Chinese.

Yanyi’s practice focuses on dispute resolution, including civil and criminal litigation, mediation, and international arbitration. She has extensive experience in commercial disputes, investigations, and matters relating to the environment, health and safety, employment, and professional liability. 

She advises and represents clients in cross-border disputes across a wide range of industries, including manufacturing and distribution, real estate development, construction and engineering, telecommunications, banking and finance, and energy.

Yanyi was seconded to Allen & Gledhill (Myanmar) from 2017 to 2019, with a focus on advising on commercial disputes, instructing local advocates in Myanmar court proceedings, and acting as counsel in international arbitrations. 

She is a firm believer in working towards amicable and commercial resolutions. Yanyi regularly advises clients on strategy and risk management before the commencement of proceedings and exploring alternative dispute resolution. She is an Accredited Mediator with the Singapore Mediation Centre and is appointed to the Law Society Mediation Scheme Panel of Mediators. 

Yanyi graduated from King’s College London with an LL.B. (Hons) degree in 2011 and was called to the Singapore Bar in 2013. 

Yanyi is fluent in English and Mandarin.

She previously held roles in both the public and private sectors, and has experience in various areas including law (dispute resolution, corporate restructuring, cross-border transactions), policy, data analysis, business development, and communications.

Ameline graduated with Honours from the NationalUniversity of Singapore (NUS), and is called to the Singapore Bar, She also holds a certificate in Innovation and Strategy from Harvard University.
