An In-Depth Discussion on AML Amendment with Herbert Smith Freehills and its Joint Operation Firm Kewei.

Event details

On 24 June 2022, the Decision to Amend the Anti-Monopoly Law 反垄断法 (“Amended AML” 2022修订版) was officially passed and will come into force as of 1 August 2022. The changes introduced in the Amended AML display the ever-increasing significance of antitrust policy in China’s administration.

What has changed in China’s Amended AML? What will the revised Anti-Monopoly Law (“AML”) mean for foreign businesses in China?

The British Chamber of Commerce Shanghai and its Legal & Compliance Committee invite Frances Xu, Partner at Herbert Smith Freehills Kewei, and Howard Chan, Senior Associate, Herbert Smith Freehills to share the key highlights from the amendments.

We are delighted to invite members and friends to the webinar on Friday, 29 July, 3.00 pm – 4:30 pm, Beijing Time.

Key Takeaways

This webinar dissects the recent amendments to the AML, which represented a key step in the development of Chinese competition policy. The amendments cover a range of areas including anti-competitive behaviour and merger control, and carry significant and far-reaching implications:

  • Status of China’s competition policy has been elevated.
  • Enforcement focus against the digital and tech sectors are now entrenched in legislation.
  • Resale price maintenance is no longer “per se” illegal.
  • Penalties for infringement are significantly increased.
  • Merger control regime has been revised, and may be followed with updated jurisdictional filing thresholds, guidance on what it means to “implement” a concentration, increased discretion on the SAMR to consider transactions below thresholds or mitigating factors in gun-jumping cases etc.
